The purchase of products offered on the MATAHA PARFUMS Website is subject to these general terms and conditions of sale ("General Terms and Conditions of Sale").
These conditions apply to the exclusion of all other conditions, particularly those in force for in-store sales.
MATAHA PARFUMS may at any time modify or update these General Terms and Conditions of Sale.

1 – ORDERING PROCEDURES
The MATAHA PARFUMS website allows you to order products from the "MAISON MATAHA PARFUMS" brand online via www.matahaparfums.com.

Products are described and presented with the greatest possible accuracy, mentioning their essential characteristics as defined in Article L. 111-1 of the French Consumer Code.
Each time you place an order on the MATAHA PARFUMS Website, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in force on the date of your order by checking the box provided for this purpose.
Otherwise, the order cannot be placed.
You must carefully check the accuracy of your selection before confirming your order. You are informed that the order is subject to a payment obligation.
An order confirmation will be sent to you by email; this email will contain, on the one hand, an acknowledgment of receipt of your order with a description of the selected MATAHA PARFUMS products, the quantity, the price, and the shipping costs, the associated payment, and on the other hand, the GTC in the version you accepted, thereby constituting proof of the order and the contract concluded.
Unless proven otherwise, the data recorded by MATAHA PARFUMS constitutes proof of all transactions made by MATAHA PARFUMS and its customers.
The order status can be consulted at any time by the customer from your customer account accessible from the MATAHA PARFUMS Website, access to which is reserved for you by a password of your choice. The information and details completed by the customer can be modified at any time by the customer; the latter can also access information relating to any previous orders.
2 – AVAILABILITY
Our product offers and prices are valid as long as they are visible on the website, within the limits of available stock. In the event of product unavailability after placing your order, we will inform you by email as soon as possible, offering you either to order another item presented on the MATAHA PARFUMS Website as a replacement, or to cancel your order. If you choose to cancel your order, you will be refunded immediately if your bank account has been debited.
Orders placed on the MATAHA PARFUMS website are reserved for individuals and "end-user" businesses. Resale or distribution of MATAHA PARFUMS products purchased on the MATAHA PARFUMS website is strictly prohibited.
MATAHA PARFUMS is a retailer and does not intend to sell the products offered in large quantities. Consequently, MATAHA PARFUMS reserves the right to limit the quantity of products ordered or to refuse orders for the same product in large quantities, in accordance with applicable provisions, particularly those of Article L122-1 of the French Consumer Code.
MATAHA PARFUMS reserves the right to change the products offered for sale on the MATAHA PARFUMS website at any time and without prior notice.
3 – OFFER
MATAHA PARFUMS product prices are indicated in euros and include all taxes, excluding participation in processing and shipping costs.
MATAHA PARFUMS reserves the right to modify the prices of products offered on the MATAHA PARFUMS Website at any time and without prior notice. Products are invoiced based on the rates displayed on the MATAHA PARFUMS Website at the time your order is placed, subject to the availability of the ordered products at that moment.
The products remain the property of MATAHA PARFUMS until full payment of the price by MATAHA PARFUMS. However, you assume the risks (including loss, theft or deterioration) concerning the delivered products from the effective date of delivery.
Except for refunds provided for below, MATAHA PARFUMS will not refund VAT applied to purchases made on the MATAHA PARFUMS Website (even if the buyer, after receipt, re-ships MATAHA PARFUMS products to a country outside the European Union).
4 – PAYMENT
Any order placed on the MATAHA PARFUMS Website must be paid for immediately at the time of your order. We only accept payments by credit card, PayPal or Apple Pay.
All orders are payable in euros. Your order will only be shipped after verification of your payment method and receipt of authorization to debit your card.
Your credit card will only be debited when your order is shipped. In the event of unavailability of certain ordered items, only the price and shipping costs related to the available products will be debited.
MATAHA PARFUMS uses the SSL encryption process to protect all data related to personal information and payment methods. In all secure areas where the URL address begins with https:// (where the "s" means secure), information is encrypted and thus protected before being transferred via the Internet.
For certain orders, you may be asked to proceed with an authenticated and secure payment via the 3D Secure system (via "Verified by Visa®" or "MasterCard® SecureCode"). In this case, you will need to enter the personal information requested by your bank to finalize your payment.
The accepted payment methods are: Carte Bleue, Visa Card, American Express Card, Master Card, and PayPal.
5 – FRAUD PREVENTION
MATAHA PARFUMS reserves the right to cancel or refuse an order from a customer with whom it has a dispute regarding a previous order, or if MATAHA PARFUMS reasonably believes that the customer has violated these General Terms and Conditions or has engaged in fraudulent activity, or for any other legitimate reason.
In case of loss, theft or any fraudulent use of your password, you agree to immediately inform MATAHA PARFUMS.
6 – DELIVERY
Products purchased on the MATAHA PARFUMS Website can be delivered worldwide.
Before final validation of your order, the amount of shipping costs is clearly stated.
Customs duties or import taxes may be added to the shipping costs, depending on the regulations in force in the country of delivery. It is the buyer's responsibility to inquire with the customs authorities of their country to ascertain the amount and procedures.
Products are shipped to the delivery address you provided when placing your order.
Orders are delivered via Colissimo or DHL in accordance with the indicative shipping times below, to which is added a processing time for your order and delivery to the carrier, with a maximum duration of 72 hours.
- Metropolitan France: 2 to 3 (minimum indicative time in working days)
- European Countries: 4 to 6 days (minimum indicative time in working days)
- World: 5 to 7 (minimum indicative time in working days)
In the event of a shipping delay of more than 7 days, you have the option to cancel your order or allow us additional time to deliver, in accordance with legal provisions.
MATAHA PARFUMS reserves the right to split deliveries. Your credit or payment card will be debited in the same way to match the price of the products actually delivered. Shipping costs will only be charged for a single shipment and in accordance with the information in your order summary.
7 – DELIVERY PROBLEMS
Any defect or delay in delivery exceeding seven (7) days must be reported to our Customer Service as soon as possible.
You must check the conformity of the goods upon delivery and indicate any anomalies observed (open package, damaged product, etc.) on the delivery note in the form of handwritten reservations accompanied by your signature. You must then contact Customer Service within two (2) days of delivery by email at contact@matahaparfums.com.
Our customer service response time is 24 to 96 hours, Monday to Friday from 9:00 AM to 5:00 PM (French time).
8 – CANCELLATION
Cancellation
Once completed, your order is transmitted to MATAHA PARFUMS for processing.
You can modify or cancel it by contacting customer service by email at contact@matahaparfums.com as long as it has not been shipped.
Return
Once shipped, for security reasons, no returns are possible.
9 – LEGAL GUARANTEES – EXCLUSIONS OF WARRANTY
In accordance with the legal provisions in force, we will refund or exchange defective, non-compliant products or products that do not correspond to your order. Any claim for a defective product must be submitted to our customer service via contact@matahaparfums.com within 48 hours of receiving the order. After this period, no exchange due to a damaged product will be taken into account.
Products sold on the MATAHA PARFUMS Website are subject to the legal warranty conditions provided for by articles L 211-4, L 211-5 and L 211-12 of the Consumer Code as well as by articles 1641 and 1648 of the Civil Code:
Article 1641 of the Civil Code: The seller is bound to a warranty against hidden defects of the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that use that the buyer would not have acquired it, or would have given a lower price for it, had he known of them.
Article 1648 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect. In the case provided for by Article 1642-1, the action must be brought, under penalty of forfeiture, within one year following the date on which the seller can be discharged from apparent defects.
Article L211 -4 of the Consumer Code: The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They are also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this was their responsibility under the contract or was carried out under their responsibility.
Article L211-5 of the Consumer Code: To be compliant with the contract, the goods must: Be fit for the purpose usually expected of similar goods and, where applicable, correspond to: the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect given the public statements made by the seller, by the producer or by their representative, particularly in advertising or labeling; or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by them.
Article L211-12 of the Consumer Code: The action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.
10 – INTELLECTUAL PROPERTY
The MATAHA PARFUMS Website is protected by copyright. The use of all or part of the Site, particularly by downloading, reproduction, transmission or representation on any medium and by any means, for purposes other than personal and private use for non-commercial purposes, is strictly prohibited.
The company names, trademarks, and distinctive signs reproduced on the MATAHA PARFUMS Website are also protected under trademark law. The reproduction or representation of all or part of any of the aforementioned signs must be subject to prior written authorization from MATAHA PARFUMS.

In no event shall MATAHA PARFUMS be held liable for any indirect, incidental, special or accessory damages, including, but not limited to, loss of operations, loss of profit or opportunity resulting from the purchase of MATAHA PARFUMS products on the MATAHA PARFUMS Website.
MATAHA PARFUMS's liability under the obligations of these Conditions shall not be engaged in the event that the non-performance of its obligations is attributable to a third party, even if foreseeable, to the fault of the customer, or to the occurrence of a force majeure event as defined by French courts, or to any other event that was not reasonably under the exclusive control of MATAHA PARFUMS.
The products offered comply with current French, European and American legislation and standards applicable in France, Europe and the United States. MATAHA PARFUMS cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered (for example, in the event of a product ban...).
It is your responsibility to check with local authorities about the possibilities of importing or using the products you intend to order.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to personal data concerning you. In accordance with current regulations, your request must be signed and accompanied by a photocopy of an identity document bearing your signature and specify the address to which the response should be sent.
